Abstract
Ethics and spirituality, as two fundamental components in shaping individual and social identity, play a decisive role in cultural health, social society, and the stability of societies. In the Islamic Republic of Iran legal system, the protection of public ethics and social spirituality is not merely a religious and cultural value, but rather a part of public order and one of the main duties of the government and the criminal justice system. In recent years, the expansion of organized centers of anti-ethics and spirituality, especially in the form of damaged groups, deviant cults and sects, and organized activities in cyberspace, has created new challenges for the criminal justice system. Challenges which cannot be analyzed solely in individual cases and, in many cases, are against public ethics, social spirituality, and public order. The Second Step Declaration of the Islamic Revolution, by stating the pivotal role of morality and spirituality in individual and social progress and modern Islamic civilizations, highlighted the need to deal with this issue in a reasonable, intelligent and purposeful manner and the responsibility of judicial system, especially the courts, in actively protecting these values. The present study, with an analytical description and using the relevant laws, policies and upstream documents and an analysis of judicial court procedures, examines the judicial approach to immorality and spirituality in the legal system of the Islamic Republic of Iran. In this regard, in addition to explaining the principles of judicial intervention, the challenges and shortcomings in judicial procedure and finally, citing the provisions of the Second Step of the Revolution, legislative and judicial solutions are presented to improve the efficiency of the criminal justice system and strengthen the courts in protecting public morality and social spirituality.
