اصول اخلاقی حاکم بر رابطه‌ی قضات و کارکنان دستگاه قضایی در رابطه با متهمان و مجرمان در مراحل رسیدگی و اجرا در راستای بیانیه‌ی گام دوم انقلاب

چکیده
پژوهش حاضر با الهام از بیانیه گام دوم انقلاب اسلامی، به بررسی اصول اخلاقی حاکم بر تعامل قضات و کارکنان دستگاه قضایی با متهمان و مجرمان در مراحل رسیدگی و اجرای احکام می‌پردازد. مؤلف با تأکید بر محوریت «معنویت و اخلاق» در گام دوم انقلاب، استدلال می‌کند که تحقق عدالت قضایی مستلزم تخلق کارگزاران قضایی به ارزش‌های معنوی و فضیلت‌های اخلاقی برگرفته از منابع اسلامی است. مقاله در دو بخش اصلی تنظیم شده است: 1. بخش اول: ارزش‌های معنوی: این بخش به عنوان زیربنای اخلاق قضایی، شش ارزش کلیدی را برمی‌شمارد و توضیح می‌دهد که این باورهای درونی، پایه‌های روانی و انگیزشی لازم برای رفتار عادلانه و خالصانه در منصب خطیر قضا را فراهم می‌آورند. 2. بخش دوم: فضیلت‌های اخلاقی: این بخش هفت فضیلت اخلاقی عملی و ضروری برای قضات و کارکنان قضایی را با استناد به قرآن، سنت و سیره اهل بیت(ع) تشریح می‌کند و کاربرد عملی آن در فرآیند دادرسی (مانند برخورد با اصحاب دعوا، کشف حقیقت، مدیریت جلسات و صدور حکم) تبیین می‌گردد.
نتیجه‌گیری کلی مقاله آن است که قضاوتِ عادلانه و مورد اعتماد عمومی، فراتر از رعایت صرف قوانین موضوعه، نیازمند تربیت نفس و آراستگی به اخلاق اسلامی است. دستگاه قضایی با الهام از بیانیه گام دوم انقلاب، موظف است زمینه‌های پرورش این ارزش‌ها و فضیلت‌ها را در کارگزاران خود فراهم آورد تا در پرتو «معنویت و اخلاق»، «عدالت قضایی» به عنوان یکی از ارکان اساسی تمدن‌سازی نوین اسلامی هموار گردد.

چکیده English

The present study, inspired by the Second Phase Statement of the Islamic Revolution, examines the ethical principles governing the interaction of judges and judicial staff with defendants and offenders during the stages of adjudication and the enforcement of judgments. Emphasizing the centrality of “spirituality and ethics” in Second Phase of the Revolution, the author argues which realization of judicial justice requires judicial officials to internalize spiritual values and moral virtues derived from Islamic sources. The article is organized into two main sections:
Section One: Spiritual ValuesThis section, as the foundation of judicial ethics, identifies six key spiritual values and explains how these internal beliefs provide the psychological and motivational bases necessary for just and sincere conduct in the critical position of the judiciary.
Section Two: Moral Virtues. This section elaborates on seven essential and practical moral virtues required of judges and judicial personnel, drawing upon the Qur’an, the Prophetic tradition (Sunnah), and the teachings and conduct of the Ahl al-Bayt (peace be upon them). It also clarifies their practical application within the judicial process, such as interaction with litigants, discovery of truth, management of court sessions, and issuance of judgments.
The overall conclusion of the article is that fair adjudication and public trust in the judiciary go beyond mere compliance with statutory law and require self-discipline and adherence to Islamic ethical values. Inspired by the Second Phase Statement of the Islamic Revolution, the judiciary is obligated to create conditions for cultivating these values and virtues among its officials so that, in the light of “spirituality and ethics,” judicial justice—as one of the fundamental pillars of the modern Islamic civilizational project—may be effectively realized.
