حق بر امید به عدالت: دکترین نوین قضایی بر اساس بیانیه گام دوم انقلاب اسلامی

چکیده

امید در اندیشه دینی و اجتماعی، از سنخ حالات روانی زودگذر نیست ، بلکه نیرویی کنش‌ساز و زیربنای پایداری جامعه است. با این حال، در نظام حقوق عمومی ایران، مفهوم امید کمتر به‌عنوان یک حق مستقل قضایی تحلیل شده است. این پژوهش با بهره‌گیری از منابع قرآنی، روایی، اندیشه امامین انقلاب اسلامی و «بیانیه گام دوم انقلاب»، به تبیین و صورت‌بندی «حق بر امید به عدالت» به‌عنوان دکترین نوین قضایی پرداخته است.
در چارچوب قرآن و روایات، امیدِ «رجاء» امیدی فعال و عقلانی است که با اعتماد و عمل پیوند دارد. تحلیل تطبیقی نشان می‌دهد امید حقوقی، به‌عنوان انتظار مشروع از عملکرد نهاد عدالت‌گستر، شاخصی از کارآمدی قوه قضائیه محسوب می‌شود. پژوهش با روش کیفی و تحلیل محتوای اسنادی (رویکرد استنتاجی)، داده‌های کتابخانه‌ای و حقوقی را بررسی کرده است.
یافته‌ها بیان می‌کند که امید به عدالت، حقی عمومی و فرامعیاری است که تحقق سایر حقوق بنیادین وابسته به آن است. بر اساس اصول قانون اساسی و مأموریت‌های قوه قضائیه، سه ساحت هنجاری، نهادی و اجرایی برای این حق ترسیم شده است. نتیجه آن‌که تحقق عدالت کارآمد و پاسخ‌گو، زمینه‌ساز بازتولید امید اجتماعی و پیش‌نیاز تحقق اهداف بیانیه گام دوم انقلاب اسلامی است.

The Right to Hope for Justice: A New Judicial Doctrine Based on the Second Step Declaration of the Islamic Revolution

چکیده English

Hope, in religious and social thought, is not one of the kind of transient psychological states, but rather an action‑generating force and the foundation of societal resilience. However, in the Iranian public law system, hope concept has seldom been analyzed as an independent judicial right. This research, drawing on Quranic sources, narrations, the thought of the two Imams of the Islamic Revolution and the “Second Phase of the Revolution Statement,” explains and formulates the “right to hope for justice” as a new judicial doctrine.
Within the framework of the Quran and narrations, hope (rajāʾ) is an active and rational hope that is linked with trust and action. A comparative analysis shows that legal hope, as a legitimate expectation from the performance of justice‑administering institutions, is considered an indicator of the efficiency of the judiciary. The research, using a qualitative method and documentary content analysis (deductive approach), has examined library and legal data.
The findings indicate that hope for justice is a public and trans‑normative right on which the realization of other fundamental rights depends. Based on the principles of the Constitution and the missions of the judiciary, three normative, institutional, and executive dimensions have been delineated for this right. The conclusion is that the realization of efficient and accountable justice paves the way for the reproduction of social hope and is a prerequisite for achieving the goals of the Second Phase of the Revolution Statement.
